If there is any inconsistency, the accepted written agreement will apply to the extent of that inconsistency.

3. Using this website

You agree to use this website lawfully, responsibly and in a way that does not interfere with the security, operation or availability of the website. You must not attempt to gain unauthorised access to our systems, introduce malicious code, scrape or harvest website content or personal information, copy the website for commercial use, or use the website in a way that infringes another person’s rights.

4. Website information and technology descriptions

We aim to keep website information accurate and current, but website content may contain errors, omissions or outdated information. Product descriptions, third-party software features, compatibility statements, service inclusions, pricing, availability and technical capabilities may change from time to time.

Any information about XMPie, QuotePrint, Google, hosting, cloud environments, APIs, integrations or other third-party products is provided for general information only. The applicable third-party provider’s own documentation, licence terms, support terms and release notes should be consulted for current and authoritative product information.

5. Enquiries, quotes and support requests

Submitting an enquiry, requesting a demonstration, contacting us or lodging a support ticket does not create a binding agreement for us to provide services. We may accept, prioritise, decline or refer work at our discretion, including where requested work is outside our expertise, resources, technology capability, support arrangements, commercial model or legal and ethical standards.

A binding commercial agreement is formed only when we issue, and you accept, a quote, proposal, statement of work, support agreement, software agreement or other written confirmation.

6. Services and project dependencies

Gexin provides technology consulting, implementation, integration, support and related services. Details of any services to be provided, including scope, deliverables, pricing, timeframes and responsibilities, will be set out in a separate quote, proposal, statement of work, support agreement or other written agreement.

Project outcomes and delivery timeframes may depend on factors outside our reasonable control, including the availability of third-party software, hosting providers, customer systems, data quality, access permissions and timely customer feedback and approvals.

7. Customer information, systems and access

You are responsible for ensuring that any information, data, content, files, credentials, licences or other materials you provide to us are accurate, lawful and authorised for the intended purpose.

Where services require access to your systems or third-party platforms, you warrant that you have the authority to grant such access and to instruct us to perform the requested work.

8. Third-party software and services

Our services may incorporate or interact with third-party software, platforms, hosting providers, integrations and technology services.

Third-party products and services are subject to the relevant provider’s terms, conditions, licensing requirements and service levels. We are not responsible for the performance, availability, security, pricing or ongoing operation of third-party products or services except to the extent required by law.

9. Intellectual property

Unless otherwise stated, all intellectual property in this website and its content is owned by or licensed to us. This includes text, graphics, layouts, designs, images, logos, trade marks, icons, resources, code, documents, service descriptions and other materials. Nothing in these Terms and Conditions excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

To the maximum extent permitted by law, we are not liable for any indirect, consequential or special loss, including loss of profit, revenue, opportunity, goodwill, data or business interruption arising from your use of this website or reliance on information published on this website.

Where liability cannot be excluded but can be limited, our liability is limited, at our option and to the extent permitted by law, to re-supplying the relevant services or paying the cost of having the relevant services re-supplied.

13. Privacy and cookies

We may collect personal information when you use this website, submit forms, lodge support tickets, request demonstrations, contact us or engage with our services. 15. Changes to these terms

We may update these Terms and Conditions from time to time by publishing the updated version on this website. The updated version applies from the date it is published.
